          No. He doesn't. And how does this make HER the racist anyway? The was already a lower court decision. Was THAT judge a racist? Was the judge (judges?) that joined her decision in the appellant court racsists? Were the four discenting judges on the SCOTUS (who Windbagh doesn't even realize exsist) racists? Of course not. Because in this idiots sick, tiwsted mind, a white personb CAN'T be a racist. To be a racist, you must first be a MINORITY. Idiot.

        He noted it was 5-4 but then he goes on to say if you read Gensburg than it "was 9-zip". I am not sure which law school Rush graduated from. The EIB school of law?

        What, you think you've heard the whole story. This is Media Matters. It's in their job description to take Rush Limbaugh's comments out of context. Here's a little context.

        "And this is why brilliant legal analysts are saying this decision when you get down to it is actually 9-zip, not 5-4 when you look at some of the things that Ginsburg wrote about the mistakes and not even hearing the case, not even taking the constitutional questions. And the reason for this is... I go back to what I said at the beginning, and I stand by this."

      I swear, every time this wind-bag spews his waaaaaaaay right wing propaganda, another cluster of his followers become FORMER followers. He's so damn far out there that he's alienating the very people who've made him a multi-millionaire...and I, for one, LOVE it!!

        He said it was a 5-4 decision @ :11 of tape.

        He went on to point out that ALL the SCOTUS
        justices rejected her (and rest of Second Circuit)
        summary judgment. She was careless, they all agreed.

        Great quality for a lib, bad for America.

          Would you mind telling us how El Fathead determined that all 9 of the Justices rejected Sotomayor's summary judgment?

          Or is this just some more Brain Tirds Rush has gotten into your head?

            I assume you know how the first 5 of 9 rejected Sotomayor's reasoning.

            From decision (signed on to by 4 dissenting Justices):

            [The lower courts focused on respondents’ “intent” rather than on whether respondents in fact had good cause to act. See 554 F. Supp. 2d 142, 157 (Conn. 2006). Ordinarily, a remand for fresh consideration would be in order. But the Court has seen fit to preclude further proceedings. I therefore explain why, if final adjudication by this Court is indeed appropriate, New Haven should be the prevailing party.]

            That reads that dissenting Justices rejected the reasoning of the panel, and they created their own standard for deciding the case. A standard different than the panel.

            9 SCOTUS Justices decided her reasoning was defective. Even the libs.

      A 5-4 decision in reality is 9-0.

      I love how Rush finishes this piece by saying "my interpretation"
      since when is journalism an interpretation?
